Terms of Service

§ 1. General provisions

1. These terms of service (the “Terms”) set out the rules for using the mobile game Hockey Beasts (the “Game”).
2. The provider of the Game and the service provider is Revulo Games spółka z ograniczoną odpowiedzialnością (Revulo Games sp. z o.o.), with its registered office at aleja 29 Listopada 85, 31-408 Kraków, Poland, entered in the Register of Entrepreneurs of the Polish National Court Register under KRS number 0000904975, NIP: 9452245302, REGON: 389176878, share capital: PLN 100,000.00, e-mail: support@revulogames.com (the “Publisher”).
3. The Game is an arcade sports game (ice hockey) for mobile devices. Downloading and using the Game is free of charge; the Game offers optional in-app purchases (Coin packs).
4. Use of the Game is conditional upon acceptance of the Terms in the Application: on first launch, and again on each amendment of the Terms (§ 13).
5. The Player may terminate the contract for the provision of the Game service at any time, without giving a reason, by ceasing to use the Game and uninstalling the Application (the effects are described in § 4); this does not deprive the Player of any claims arisen before termination.
6. The Terms are permanently and free of charge available at revulogames.com/mobile/hockey-beast-terms.html, in a form that allows them to be obtained, reproduced, recorded and printed.

§ 2. Definitions

1. Game — the Hockey Beasts mobile game, made available by the Publisher through the Application.
2. Application — the Game software installed on the Device, downloaded from Google Play or the App Store.
3. Player — a natural person using the Game on the terms set out in the Terms.
4. Device — the Player’s mobile device on which the Application is installed.
5. Local Profile — the set of data on the Player’s progress (including the Coin balance, player levels and the number of Fans) stored solely locally on the Device, in accordance with § 4.
6. Coins (Virtual Currency) — virtual units used solely within the Game, earned in gameplay or purchased in the Application. Coins are neither money nor a means of payment, are not exchangeable for money and cannot be cashed out, and their sole function is use within the Game.
7. Stake Match — a game mode in which participation requires payment of an Entry Fee, and the winner receives winnings in Coins in the amount indicated in the Game before joining the match.
8. Entry Fee — the number of Coins indicated in the Game, paid on joining a Stake Match.
9. Pot — the sum of the Entry Fees of the participants in a given Stake Match.
10. Platform Account — the Player’s account with Google Play (Google) or the App Store (Apple), maintained on the terms of the platform operator.

§ 3. Conditions of use

1. The Game may be used by persons who are at least 13 years old. Minors use the Game with the consent of their legal guardian; this applies in particular to in-app purchases. The Publisher respects Google Play / App Store parental control settings, including purchase limits and approvals.
2. Using the Game requires: a Device running Android 7.1 or later, or iOS 15.0 or later, a Platform Account, and free storage on the Device. Playing matches requires an internet connection; data transmission costs are borne by the Player according to their operator’s tariff.
3. Upon installation of the Application, the Publisher grants the Player a non-exclusive, non-transferable licence to use the Game for personal, non-commercial purposes, on the Player’s Device, for the duration of their use of the Game, without the right to sublicense.
4. The following is prohibited: interfering with the code, files or operation of the Game; decompilation and reverse engineering (except where mandatorily permitted by law); using the Game for commercial purposes without the Publisher’s consent; and supplying unlawful content.
5. Intellectual property rights to the Game (code, graphics, animations, music, sounds, name, marks) belong to the Publisher or its licensors.

§ 4. Saving progress (Local Profile)

1. Progress in the Game is saved solely locally on the Device. In its current version the Game offers no online accounts, no cloud backup and no transfer of progress between devices.
2. WARNING: uninstalling the Application, clearing its data, restoring the Device to factory settings, as well as loss, damage or replacement of the Device result in the irretrievable loss of the Local Profile, including all Coins — also those acquired for payment. Information about this characteristic is also presented to the Player before the purchase of a Coin pack (§ 10(4)).
3. Paragraph 2 does not apply to data loss for reasons attributable to the Publisher (e.g. a faulty Application update) — in such a case the Publisher is liable under the provisions on conformity of digital content with the contract; the Player may submit a complaint (§ 14).
4. The provisions of this paragraph describe the technical characteristics of the Game and do not exclude or limit the Player’s statutory consumer rights.

§ 5. Gameplay and Stake Matches

1. The core mode of the Game is Stake Matches. Participation requires holding in the Local Profile at least the number of Coins equal to the Entry Fee applicable to the given arena.
2. The Entry Fee is charged only upon being matched with an opponent and the start of the match. Searching for an opponent, and cancelling the search before being matched, are free of charge.
3. The Entry Fees of both participants form the Pot. The winner receives the Pot less the Publisher’s commission of 10% of the Pot; the exact amount of the Entry Fee and of the winnings is displayed in the Game before joining the match and is binding for settlement.
4. In the event of a draw, each participant receives a full refund of their Entry Fee; no commission is charged.
5. Match settlement may be modified by ad rewards referred to in § 11(2) (in particular a partial refund of the Entry Fee after a loss).
6. Match results affect the Player’s rating (“Fans”): a win increases and a loss decreases the number of Fans. Fans are solely an internal progression metric and do not constitute a currency or an asset.
7. Arenas differ in the amount of the Entry Fee; access to further arenas is unlocked by reaching the number of Fans indicated in the Game, and a drop in that number may temporarily close access to higher arenas.
8. Playing a match in certain arenas may require a one-off download of additional Game data. The Game informs the Player of the need to download before the match begins; data transmission costs are borne by the Player.

§ 6. Opponents

1. The matchmaking system seeks to pair the Player with another Player.
2. If no other Player is found within the time indicated in the Game (approximately 20 seconds), the match — including a Stake Match — is played against a computer-controlled opponent, whose skill level is selected according to fixed criteria (in particular the arena) so as to match the level of play, and is not modified during the match or according to the Player’s Coin balance.
3. The settlement rules for a Stake Match (Entry Fee, Pot, commission, effect on Fans) are the same regardless of whether the opponent is another Player or a computer-controlled opponent.
4. The mechanism described in paragraph 2 forms part of the design of the Game and is openly disclosed in these Terms and in the Game’s store description.

§ 7. Disconnections and interrupted matches

1. Voluntarily leaving a match before it ends (including closing the Application during a match) is treated as a loss for the Player who leaves.
2. If the opponent leaves a Stake Match:
   1. after 30% of the regulation match time has elapsed or later — the remaining Player wins and receives the Pot on the terms of § 5(3);
   2. earlier — the remaining Player receives a refund of the Entry Fee, and the leaving Player forfeits their Entry Fee.
3. If the internet connection is lost, the Player has 30 seconds to return to the match; the ineffective lapse of that time results in the match being decided against them, with paragraph 2 applying accordingly.
4. Paragraphs 1–3 do not apply where the match was interrupted for reasons attributable to the Publisher (in particular a server failure) or affected both participants simultaneously — in such a case the match is annulled and the Entry Fee is refunded to both participants: automatically or, where an automatic refund is not technically possible, on the basis of a complaint (§ 14), without placing on the Player the burden of demonstrating technical causes lying outside their Device and connection.
5. The Player is responsible for the quality of their own internet connection. The rules of this paragraph do not limit the right to submit a complaint (§ 14).

§ 8. Fair play

1. The following is prohibited in particular: using cheats and modifications; exploiting bugs; automating gameplay (bots, macros); intentionally manipulating match results, including deliberately losing in order to transfer Coins between Local Profiles or Devices; abusing Game errors (detected errors should be reported to support@revulogames.com).
2. In the event of a breach, the Publisher may apply a sanction proportionate to the gravity, effects and recurrence of the breach: annulment of the match with a correction of the settlement; withdrawal of benefits obtained from the breach; temporary suspension of access to Stake Matches or Game features; and, in the case of gross or repeated breaches, temporary or permanent blocking of access to the Game.
3. The Publisher informs the Player in the Game of the sanction, its scope and its reason. The Player may challenge the sanction by way of a complaint (§ 14); if the complaint is upheld, the sanction is lifted or mitigated and, as far as possible, the previous state is restored.
4. Permanent blocking of access — possible only in the case of gross or repeated breaches — means the loss of access to the Local Profile together with the Coins accumulated therein. The Player may challenge the block and its scope by way of a complaint (§ 14).

§ 9. Virtual Currency (Coins)

1. Coins are purely virtual and serve solely to use the features of the Game. They are not money, electronic money, a financial instrument or a means of payment, and have no monetary value outside the Game.
2. Coins cannot be cashed out or exchanged for money or other benefits outside the Game; this does not limit the consumer rights arising from mandatory provisions of law, nor the rights under § 8(4), § 10 and § 13.
3. Coins are recorded in the Local Profile. Transferring Coins between Local Profiles, selling them and any trading in them outside the Game are prohibited.
4. The Player obtains Coins free of charge (in-game rewards: including the daily reward, tickets, missions, the weekly league, the first-win bonus, and rewarded ads) or for payment (§ 10).
5. Upon obtaining Coins, the Player acquires a limited, non-exclusive, non-transferable licence to use them within the Game; the Player does not acquire ownership of them.
6. Deleting the Game data (uninstalling the Application, clearing data) results in the irretrievable loss of unused Coins (§ 4(2)); this does not affect the Player’s statutory rights.

§ 10. Purchases

1. In-game purchases (Coin packs) are made exclusively through Google Play or the App Store, in accordance with the platforms’ terms and the prices presented before purchase confirmation (inclusive of taxes).
2. Payment is handled by the platform operator; the Player receives confirmation of the transaction from the operator. The Publisher additionally confirms the conclusion of the contract and the content of the consent given (paragraph 4) in the Application, in a form that the Player can save and reproduce. The Publisher does not collect the Player’s e-mail address and therefore does not send this confirmation by e-mail.
3. Purchased Coins are recorded in the Local Profile immediately after payment is confirmed. If they have not been delivered, the Player may submit a complaint (§ 14).
4. Before confirming a purchase, the consumer Player, separately from acceptance of the Terms (a separate, active confirmation within the purchase flow in the Application), requests the immediate supply of the digital content (Coins) before the expiry of the 14-day withdrawal period and acknowledges that upon supply they lose the right of withdrawal from the contract for the supply of that content (Article 38(1)(13) of the Polish Consumer Rights Act). The same screen presents the information that Coins are stored solely locally (§ 4(2)).
5. Payment refunds are handled by the platforms according to their own policies; irrespective of this, the Player retains statutory rights in respect of the non-conformity of digital content with the contract, and the right to submit a complaint (§ 14).
6. The first purchase of any pack permanently disables interstitial ads (§ 11(3)). This is recorded in the Local Profile and — like all other progress (§ 4) — is lost when the Game data is deleted.

§ 11. Advertising

1. The Game may display third-party advertising.
2. Rewarded ads are played solely at the Player’s request, in exchange for an in-game reward. The reward may in particular be: a Coin top-up, a multiplication of a ticket reward, or a partial refund of the Entry Fee after a lost Stake Match (“stake insurance”, approximately 50% of the Entry Fee). The types of rewards, their amounts and the daily limits are indicated in the Game; exhausting a daily limit does not constitute a defect of the Game. Declining to watch ads does not block gameplay.
3. Interstitial ads may be displayed after a match ends, solely to Players who have not made any purchase (§ 10(6)), no earlier than after the first 5 matches and no more often than every third match.
4. Personalised ads are displayed solely to Players who are at least 16 years old and have given consent in accordance with the Privacy Policy; all other Players are shown non-personalised (contextual) ads. Consent may be withdrawn at any time in the Game settings (OPTIONS → DATA COLLECTION), with effect from the moment of withdrawal. Privacy Policy: revulogames.com/mobile/hockey-beast-privacy.html.

§ 12. Withdrawal from the contract

1. A consumer Player may withdraw from the contract for the provision of the Game service within 14 days of its conclusion (acceptance of the Terms), without giving a reason, by submitting a statement to support@revulogames.com — the Player may use the model form annexed to these Terms.
2. The right of withdrawal from a contract for the supply of a Coin pack expires on the terms of § 10(4).
3. Withdrawal from the contract for the Game service involves no costs; it is sufficient to cease using the Game and uninstall the Application.

§ 13. Changes to the Game and the Terms; discontinuation of the service

1. The Publisher may update the Game, including balancing its economy and changing or withdrawing features, for important reasons: a change of law or a decision of an authority; security and the prevention of abuse; technical reasons (including platform requirements); maintaining the balance of gameplay and the stability of the economy; and development of the Game.
2. Changes to economy parameters (Entry Fee, commission, prices in Coins, rewards) do not affect matches already started and do not reduce the Player’s Coin balance; the Publisher will give advance notice in the Game of changes that materially affect the ability to use the Coins held.
3. Updates necessary to keep digital content and services in conformity with the contract are supplied in accordance with the Polish Consumer Rights Act.
4. The Terms may be amended solely for the important reasons set out in paragraph 1. The Publisher gives notice of an amendment in the Application at least 14 days in advance (unless a shorter period follows from the law or a decision of an authority), and continued use of the Game requires acceptance of the new version. Amendments do not have retroactive effect.
5. A Player who does not accept the amended Terms may terminate the contract (§ 1(5)). Changes to economy parameters do not reduce the Player’s Coin balance (paragraph 2).
6. The Publisher may discontinue the provision of the Game service, giving notice in the Application at least 90 days in advance. From the moment the closure is announced, sales of Coin packs are suspended; until the closing date, Players may use the Coins they hold in gameplay.

§ 14. Liability and complaints

1. The Publisher is liable for non-performance or improper performance of the contract, and for the conformity of digital content and services with the contract, on statutory terms (the Polish Civil Code and the Polish Consumer Rights Act). No provision of the Terms excludes or limits statutory consumer rights.
2. The Game is made available free of charge on an “as is” basis, to the fullest extent permitted by mandatory provisions of law. The Publisher makes every effort to ensure that the Game operates continuously and correctly, but does not guarantee uninterrupted availability; technical breaks are possible (maintenance, repairs, updates) and are kept to the necessary minimum.
3. The Publisher is not liable — to the extent that mandatory provisions of law do not preclude this — for:
   1. the consequences of using the Game in a manner contrary to the Terms or the law;
   2. the consequences of making the Device available to third parties;
   3. the quality, interruptions and parameters of the Player’s internet connection and the technical limitations of their Device (including the match outcomes described in § 7(1)–(3));
   4. the unavailability or malfunction of third-party services used by the Player under separate contracts with those parties (Google Play, the App Store, payment handling, internet access), unless the cause lies with the Publisher;
   5. non-performance or improper performance of the service as a result of force majeure — external events that could not be foreseen or prevented (in particular large-scale failures of telecommunications or power infrastructure, natural disasters, acts of public authority).
4. Towards Players who are not consumers (nor persons to whom consumer protection provisions apply), the Publisher’s liability is limited to damage caused intentionally and does not cover lost profits.
5. The limitations in paragraphs 2–4 do not apply to the extent that they would be contrary to mandatory provisions of law, in particular the provisions on liability for the conformity of digital content and services with the contract towards consumers.
6. Complaints (concerning the Game, purchases, match settlements or sanctions) may be submitted to support@revulogames.com, stating: the player identifier (OPTIONS → PLAYER ID), a description of the problem and, for purchases, the order number from the platform.
7. The Publisher responds to a complaint within 14 days; failure to respond within that period means the complaint is upheld.
8. Consumers may use out-of-court dispute resolution methods: the assistance of a municipal (district) consumer ombudsman or consumer organisations, as well as mediation and the permanent arbitration courts at the provincial inspectorates of the Trade Inspection; information is available at uokik.gov.pl. Participation in these procedures is voluntary for both parties.

§ 15. Final provisions

1. The governing law is Polish law; this choice does not deprive a consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence in the EU.
2. Disputes are resolved by the common courts having jurisdiction under the law; the Terms do not alter the statutory jurisdiction of the courts in consumer matters.
3. The invalidity or ineffectiveness of an individual provision does not affect the remaining provisions; the provisions of law apply in its place.
